Beacon and Beacon Wholesale (the "Theme") are made by Realmdrop LLC, a Texas limited liability company doing business as Realmdrop Software ("Realmdrop", "we", "us"). This license is an agreement between Realmdrop and the person or business that bought the Theme ("you"). By downloading, installing or using the Theme, you agree to it. It applies however you bought the Theme, including from realmdrop.com and Etsy.
The Theme is licensed, not sold. Realmdrop keeps all rights it doesn't give you here.
1. What you may do
Each purchase gives you a non-exclusive, non-transferable (except as section 5 allows), perpetual license to:
- Use the Theme on one live Shopify store (the "Licensed Store"). A store is one Shopify store account, whatever domains point to it.
- Use copies of the Theme for the Licensed Store's work: unpublished themes, development, staging and preview stores, and backups, as long as they serve only the Licensed Store.
- Change the Theme's code, settings and design for the Licensed Store, as much as you like.
Each additional live store needs its own purchase. Beacon and Beacon Wholesale are separate products, each with its own license.
2. Who may have the files
You may share the Theme, changed or not, only with:
- your employees, and
- freelancers, agencies and contractors you hire to work on the Licensed Store,
and only so they can do work for the Licensed Store. They may not use the Theme for anyone else, and they must delete their copies when the work ends. You're responsible for anyone you share it with following this license.
3. What you may not do
You may not, whether the Theme is changed or not, in whole or in part:
- give, sell, resell, rent, lend, sublicense or otherwise share the Theme with anyone outside section 2;
- publish the Theme or its code where others can get it, such as a public code repository, file-sharing site, forum or marketplace;
- use the Theme, or code or designs taken from it, to make another theme, template or product that is sold, given or shown to others;
- use it on more live stores than you have purchases for; or
- remove the copyright and license notices in the Theme's code or in
THIRD-PARTY-NOTICES.md.
You may turn off or remove the "Theme by Realmdrop Software" credit in the footer.
4. Updates and support
- Updates: for 12 months from your purchase, you can get updated versions of the Theme we release. After that, the Theme keeps working; you just don't receive newer versions unless we offer a renewal.
- Support: for 12 months from your purchase, email support through https://software.realmdrop.com/beacon/support for questions about the Theme's features and settings and for bugs in the Theme. Support doesn't cover custom changes to the code, third-party apps, or problems caused by changes made by you or others.

5. Moving the license to a new owner
If you sell or transfer the Licensed Store itself, the license can go with it. The new owner takes on this license, and you must stop using the Theme. Otherwise the license can't be transferred.
6. Refunds
Because the Theme is a digital download, purchases can't be refunded once the Theme has been downloaded, except where the law requires a refund, or where the Theme doesn't work as described and we can't fix the problem within a reasonable time after you report it. Contact us through the support link above. Refunds of Etsy purchases are made through Etsy. If you get a refund, this license ends.
7. What's included
The download contains the Theme's code, settings and translations, this license, THIRD-PARTY-NOTICES.md and installation instructions. Photos, products, logos and text shown in our demo stores and screenshots are not included. The Theme's starter text is yours to change.
8. Ownership and third-party parts
Realmdrop owns the Theme and all rights in it, including the copyright, except for parts made by others. The Theme is built on Shopify's Skeleton theme, whose code is used under Shopify's license in THIRD-PARTY-NOTICES.md. Fonts, icons and other resources served by Shopify are covered by Shopify's own terms.
Realmdrop Software isn't affiliated with or endorsed by Shopify. Shopify is a trademark of Shopify Inc.
9. Ending the license
This license ends automatically if you break it. When it ends, you must stop using the Theme and delete all copies, including changed ones. Sections 3, 8, 10, 11 and 12 continue after it ends.
10. No warranty
The Theme is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise the Theme will be error-free, will work with every app or future Shopify change, or will meet every need. You're responsible for testing the Theme before using it on a live store and for keeping backups.
11. Limit of liability
To the fullest extent the law allows, Realmdrop isn't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, sales, data or goodwill, arising from the Theme or this license, even if told they were possible. Realmdrop's total liability for any claim about the Theme is limited to the amount you paid for it.
Some places don't allow certain warranty exclusions or liability limits; where that's the case, they apply only as far as the law allows.
12. Law and courts
This license is governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute will be handled by the state or federal courts located in Texas, and both parties agree to their jurisdiction, unless the law where you live gives you the right to bring a claim there.
13. The whole agreement
This license is the whole agreement about the Theme between you and Realmdrop. If any part of it can't be enforced, the rest still applies. If we don't enforce a term right away, we can still enforce it later. We may publish new versions of this license for future purchases; the version you received with your purchase applies to that purchase.
